Terms of service

By purchasing a commission the client is automatically bound to these Terms of Service. This page may be updated periodically (TOS v2.2).
If you haven't contacted me yet You can fill my google form to commission me, after you filled my Google form I'll contact you regarding your commission.

General

▪ Conversations regarding commissions can be conducted in any of my social medias but Telegram and Discord are prefered @sekielmoon (TG), SekielMoon#7112 (Discord). Emails are reserved for "business purposes" meaning for business proposals by agents or companies, If you cannot seem to reach me through any of these mediums send an email explaining the situation.
▪ I might message you asking for more info about your commission just so I can understand completely what you want, so please pay attention to any messages I'll send you regarding your commission.
▪ Please have clear visual references of your characters.
▪ Please have clear visual or written references for your commission's description, unless artistic freedom is given to me by you
▪ Please specify anything particular of your character's anatomy that I should know beforehand (ie: male/female body, has breasts, type of body, etc) if nothing is specified I'll work with what's given in the references.
▪ If you are interested on a commission for the next batch please let me know so I can add you to the interested tab!
▪ I work with the following aspect ratios:
★ 1:1 (Square) ★ 4:5 (Vertical) ★ 5:4 (Horizontal) ★ 16:9 (Wallpaper) ★ A4/A3/A2 (for printing)
I'll try to accomodate what you want to one of these aspect ratios but if you want a specific one please make sure to tell me.

Publishing

▪ I reserve the right to display commissioned artwork for advertising and self promotion purposes unless the client explicitly requests their commission be private. This must be noted at the time of purchase or before the artwork is completed Private commissions carry a fee of $20 USD
▪ You can print purchased artwork for your own personal use, provided it is not for profitable means.
▪ If you want to credit me, credit under the name Sekielmoon, or link directly to any of my social medias.
▪ You can publish purchased artwork on your own social media, in online art galleries, and in online character archives. You can also print, or crop artwork for private nonprofit use, such as social media banners, icons, backgrounds, physical art prints, or physical stickers. This is provided my signature remains intact on the artwork, if my signature is cut off due to the image being cropped, such as for a social media icon or banner, the client is not required to move or rewrite my signature on the cropped artwork.
▪ I retain the rights to exhibit my artworks in the physical world, with the stipulation that they are not to be sold, as the characters depicted in commissioned pieces are the property of their respective owners.

Queue

▪ All commissions are listed on my public queue located on my Trello
▪ Unpaid commissions that have exceeded 4 days in the queue without response from the client, and if no other arrangements have been made, will be removed from the queue with notice and the order considered forfeit.
▪ Every commission is subject to my current turnaround time and complexity! Larger orders may require more time. But TAT is always specified on my posts (Usually, it's 1 month, but it can be extended, please read my commissions post to inform yourself!)

Work in progress updates

▪ Work in Progress updates [or WIPs] are progress updates sent back to the client for approval before the commission is finished. A WIP will be sent after the sketch phase has been completed and when flat colors have been applied to the character(s) and background.
▪ Whenever I send you a WIP of the commission I'll wait for your feedback, please tell me about any changes you want to do before I keep working on your drawing.
▪ After the first WIP is sent the client may ask for more WIPs in the process but keep in mind my turnaround time and progress might be slower depending on the complexity of the artwork.
▪ If the client was sent a WIP and would like to make large changes to the artwork that would impact the integrity of the lineart (such as readjusting the pose or make large changes to the background or characters) it will be considered a Large Change and a small fee of $10 USD will be charged and added to the final price.
▪ You can ask for up to 3 changes/fixes for your commission. Further changes/fixes will result in a $10 USD charge per change/fix added to the final price

Adopts rules

▪ You are allowed to use the character for personal purposes and give them a name, personality, gender, etc.
▪ Adoptables can be resold, but only at the same price you purchased them. If you have additional artwork specifically made or purchased for that character, you may include the price of the extra art in the resale.
▪ Adoptables are non-refundable.
▪ You cannot claim the artwork or the original design as your own
▪ Adoptables won in raffles cannot be sold or offered to adopt (OTA).

Finished artwork

▪ Finished artwork will be sent through Discord, Telegram or at your email for uncompressed files.
▪ You can request final tweaks to finished artwork, such as changes to the contrast, brightness, saturation, or value corrections [How light or dark the colors are] of the piece.
▪ If you want me to make changes to the final artwork a fee of +$10 USD will be applied for each change
▪ I CAN'T make BIG changes to a finished artwork (ie: changing the position of the character, large changes to the background or character) since this is the same as redoing the artwork due to the amount of layers comprised in the process.

Payments and refunds

▪ By paying the commission, you are agreeing with all these terms.
▪ Payments are upfront and must be made in full through Paypal.
▪ The client understands that they are paying for the non-refundable time and expertise of an artist. Completed commissions are not eligible for refund.
▪ You may not sell your commission.
▪ If a refund must be issued before the artwork is completed, the client will receive a refund of 50% of the total price, if the First WIP was sent. This is because I 3D model all my scenes before starting the sketch and it's considered as non refundable time.
▪ Chargebacks issued by a client's financial institution, or Paypal MUST be compensated by the client.
▪ Invoices are due within 4 days of issue. If the client has not paid, or made other arrangements with me, then their order will be removed from my queue and their commission will be considered forfeit.
▪ I own full copyright to my art and you can't use it for commercial profit.
▪ Price can change depending on character complexity, ie: wings, complex patterns, any kind of large clothing or complex armor, complex objects, the price for each complex item is +$10 USD
